This is Tampay!
The Tampay service, website and/or software application (collectively, the “Service”) enables you to transfer funds between your mobile money wallet and your bank account, as well as to the wallet/account of another user. It also enables you, through your supported mobile money wallet, account or debit/credit card, to pay for products and services offered by third parties (“Products”). The Service is operated by Tampay by Cq Ltd (“Tampay”), subject to these Terms of Service (“Terms”).
Terms of service
This is a contract.
These Terms constitute a contract between you and Tampay. If you do not accept these Terms, please do not use the Service. By using any part of the Service, you accept these Terms. If you are under eighteen (18) years of age, you must not use the Service.
You must register a wallet account with valid information.
To use the Service, you must:
- provide a valid mobile phone number;
- NIN and BVN Where necessary
- agree that an account associated with your name and such number if the Tampay desires be created;
- accept the current Terms; and
- agree to submit such other (and additional) information as Tampay may request in line with regulatory/legal provisions.
You agree to provide true, accurate and complete information about yourself as prompted by Tampay during the account registration process.
You must ensure that any third-party information you provide to Tampay has been authorized appropriately.
You will be given the option of receiving a unique PIN for purposes of reusing your account. You are responsible for keeping your PIN secure at all times, without reservation. For the avoidance of doubt, Tampay will not be responsible when/where you compromise your details by disclosing it to third parties.
Tampay will not be responsible for any liability for any fraud or money lost on your account due to negligence on your part or as result of your failure to report immediately, compromise of your account or account details.
Third-party merchants offer the goods & services. The Service provides an opportunity to discover offers from independent third-party merchants (“Merchants”). These Merchants sell their respective Products subject to their own terms and conditions. To illustrate:
- Airtime: If you choose to purchase pre-paid airtime, you do so pursuant to the relevant terms and conditions of your mobile telecommunications provider.
- Utilities: If you choose to purchase pre-paid electricity or water, you do so pursuant to the relevant terms and conditions of the utility provider.
- USSD Subscription Service: If you subscribe to the USSD Service, you agree that Tampay may charge you the attendant fees related to the service, and pursuant to the relevant terms and conditions of your mobile telecommunications provider.
If you decide to purchase Products such as these from third party Merchants, you do so at your own risk and subject to the relevant Merchant’s terms and conditions. We are unable to investigate, monitor, or check the products for accuracy, reliability, appropriateness or completeness. By granting you access to discover the Products via the Service, Tampay does not imply approval or endorsement of such Products. You therefore agree that Tampay is not responsible or liable for the Products you purchase from Merchants.
Payments are processed by third parties.
In order to facilitate your purchases from Merchants, Tampay has integrated its Service with the billing solutions of certain mobile money providers and credit card issuing banks (“Payment Processors”). When you purchase a Product from a Merchant using your supported mobile money wallet or account or debit/credit card, payments will be processed by such Payment Processors. Payment Processors have their own terms and conditions governing your use of their payment services. You understand and agree that Tampay does not process payments and is not responsible or liable for any transactions in which you engage. By engaging in a purchase transaction using your mobile money account or debit/credit card, you authorize the Merchant (or Tampay on its behalf) to bill your account or card for the purchase amount.
Tampay also uses the API’s of other service providers for the purpose of sending and receiving money into your wallet and you agree to abide by the terms of these service providers. Tampay shall not be responsible for any liability caused by these service providers.

9 Payment Service Bank

Tampay’s list of third-party partners will be updated as needed.
Your privacy is important to us.
Tampay takes the matters of protection and security of its users’ information very seriously.
Tampay’s privacy policy governing the Service is attached to these Terms (“Privacy Policy”). The Privacy Policy is incorporated into these Terms by this reference. By using the Service, you agree to the use of your data under Tampay’s Privacy Policy. The Privacy Policy addresses only the personal information processed by Tampay in providing the Service to you. Merchants and Payment Processors have their own information-gathering practices which apply when you choose to purchase their Products.
Product inquiries should be submitted to the relevant Merchant.
If you have any questions, concerns or requests related to a Product you have purchased from a Merchant, please contact the Merchant directly or contact us at help@tampay.co.
Each Merchant maintains its own customer contact desk for handling such requests, however Tampay will do its best to assist you. If you wish to submit a complaint about the practices of a Merchant offering its Products via the Service, you may contact us by email at help@tampay.co.
You must not use the Service to violate any laws.
including the rights of other users, Tampay’s rights in the Service or Merchants’ rights in their Products. You must not breach any laws or regulations when using the Service or attempt to disrupt or interfere with the security or functionality of the Service.
In the event that Tampay reasonably suspects that you are using the Services for illegal activities (particularly fraud, money laundering or other related illegalities), Tampay reserves the right to block your account immediately without liability. Such illegalities as mentioned above may be as a result of enacted laws, court judgments, rulings or pronouncements, or regulatory policies and guidelines to which Tampay is bound. If a breach is associated with your account/wallet, you agree that we have the right to apply restrictions to your account/wallet and report to the appropriate law enforcement agencies or the respective regulator, in line with extant laws without informing you.
Tampay may contact you regarding your account or the Service.
You expressly agree that, as part of the Service, you may, from time to time, receive communications from Tampay via email, instant message, telephone, text message (SMS), emails or other means. You may elect to stop receiving promotional messages by unsubscribing from our mailing list, or emailing your request to opt-out, along with your cell phone number, to privacy@tampay.co, or following the opt-out instructions in the message. Even if you choose to opt out of receiving promotional messages, you may not opt out of receiving service-related messages as these ensure that we are able to deliver accurate, relevant, sensitive and security-related services to you.
Tampay may discontinue the Service.
Tampay may, in furtherance of regulatory, time-sensitive and security-related purposes, terminate your access to the Service or discontinue providing the Service or any part of the Service, with due notice to you [or without notice where the suspension or termination is expedient to forestall, curb or extinguish some ongoing fraud, industry-wide compromise or an ongoing financial crime-related investigation]. Rest assured that we will provide as much notice as the circumstance allows, and restore the Service at the earliest convenience. You agree that in the event of the foregoing, Tampay will not be responsible or liable to you or any third party.
Tampay is not liable for any damages you may incur as a result of using the Services. In no event shall Tampay or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever arising out of, or in any way connected with the use or performance of the service, with the delay or inability to use the service, the provision of (or failure to provide services), or otherwise arising out of the use of the service, whether based on contract, tort, negligence, strict liability, or otherwise, even if Tampay or any of its suppliers have been advised of the possibility of such damages.
You agree to mediate any disputes
This Agreement is subject to, and shall be governed by, and construed in accordance with the laws of Nigeria, without reference to the principles of conflict of laws thereof. Any matters arising concerning the interpretation, validity or implementation of this Agreement not solved by mutual agreement between the Parties shall be submitted to mediation in the English language before a sole mediator to take place in Lagos, Nigeria, unless impractical to do so. Nothing in this Agreement will be deemed as preventing Tampay from seeking injunctive relief (or any other provisional remedy) from any court having jurisdiction over the Parties and the subject matter of the dispute as is necessary to protect Tampay’s name, proprietary information, trade secrets, know-how, or any other intellectual property rights.
Tampay may modify these Terms
We may modify these Terms and related policies (including, but not limited to the Privacy Policy) at any time in the future. Where this happens, we will communicate the changes to you. By continuing to use the Service, you agree to be bound by the latest version of these Terms. It is your responsibility to familiarize yourself with the communicated changes.
Tampay is a cooperative society and you agree that by using Tampay you are a member of its cooperative society.
Alteration
No alteration, variation or agreed cancellation of this agreement, and the Privacy Policy, shall be of any effect unless so directed by us.
Whole Agreement
This Agreement constitutes the whole agreement between the parties in regard to the subject matter hereof and no warranties or representations of any nature whatsoever other than set out in this agreement have been given by any of the parties.
Waiver/Relaxation
No relaxation or indulgence which Tampay may show to you shall in any way prejudice or be deemed to be a waiver of its rights hereunder.
Survival
Each and every provision of this Agreement (excluding only those provisions which are essential at law for a valid and binding Agreement to be constituted) shall be deemed to be separate and severable from the remaining provisions of this Agreement. If any of the provisions of this Agreement (excluding only those provisions which are essential at law for a valid and binding Agreement to be constituted) is found by any court of competent jurisdiction to be invalid and/or unenforceable then, notwithstanding such invalidity and/or unenforceability, the remaining provisions of this Agreement shall be (and remain) of full force and effect.

Tampay Finance provides financial services through our website and software application (collectively, the “Service”). These services include instant transfers, bill payments, virtual USD and Naira cards, and NFC transfers. Tampay Finance is operated by Tampay Finance Limited (“Tampay”), and by using our Service, you agree to comply with and be bound by these Terms of Use (“Terms”).
Agreement to Terms
These Terms constitute a legally binding agreement between you and Tampay. By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms. If you disagree with any part of these Terms, you should not use the Service.
Account Registration
To use the Service, you must register an account with a valid mobile phone number. When you register, you agree to the following:
Valid Information:
You must provide accurate, current, and complete information as requested during registration.
Account Creation:
An account will be created for you based on the phone number provided.
Compliance:
You must accept these Terms and agree to provide any additional information required by Tampay in accordance with legal and regulatory requirements.
You should ensure that all information provided are correct and updated. You are responsible for keeping the confidentiality of your account credentials and any PIN required. Tampay is not liable for any unauthorized use or access to your account resulting from failing to secure your credentials.
Services Offered
Tampay provides several financial services through the Service, including:
Instant Transfers:
Seamlessly transfer funds between accounts. This service allows you to send and receive money almost instantly.
Bill Payments:
It enables you to pay for utilities, such as electricity, airtime, data, and other services. Payments are made through the Service but are subject to the terms of the utility providers.
Virtual Cards:
Issue and manage virtual USD and Naira cards for online transactions. These cards are designed to provide a secure method for making online purchases.
NFC Transfers:
Use Near Field Communication (NFC) technology to transfer funds quickly and conveniently by tapping your device to make payments.
Third-Party Services
The Service may provide access to third-party merchants and service providers. These third parties offer products and services not controlled or endorsed by Tampay. You are subject to their terms and conditions when you make transactions with third-party merchants. Tampay does not guarantee the accuracy, reliability, or quality of products or services provided by third parties. You agree that Tampay is not responsible or liable for any issues arising from transactions with these third parties.
Payment Processing
Third-party payment processors process payments made through the Service. Tampay does not directly handle payments and is not responsible for any issues related to payment processing. Each payment processor has its terms and conditions, which govern the use of their payment services. Using the Service to make payments, you authorize Tampay and the relevant payment processor to process the transaction on your behalf.
Privacy
Your privacy is of utmost importance to us. Our Privacy Policy, incorporated into these Terms by reference, outlines how we collect, use, and protect your personal information. You consent to the data practices described in our Privacy Policy when using the Service. You can review the Privacy Policy here. Please note that third-party merchants and payment processors have their own privacy policies, and we are not responsible for their practices.
Product Inquiries and Support
Please get in touch with the relevant merchant directly for questions or concerns regarding transactions or products. Each merchant maintains its customer support services to handle such inquiries. For general support or issues related to the Service, you can contact us at support@tampay.co. While Tampay will assist where possible, we are not responsible for resolving problems directly related to third-party products or services.
Legal Compliance
You must comply with all applicable laws when using this Service. Tampay reserves the right to suspend or terminate your access to the Service if we suspect any illegal activity, including fraud or money laundering. Such actions may be taken following regulatory requirements or legal obligations. We may also report suspicious activities to the relevant authorities.
Communication
By using the Service, you consent to receive communications from Tampay via email, telephone, text messages (SMS), or other means. These communications may include service-related messages, updates, and promotional content. You can opt out of receiving promotional communications by emailing support@tampay.co or following the opt-out instructions provided in the message. However, you cannot opt out of service-related messages as they are necessary for the functioning and security of the Service.
Termination and Suspension
Tampay reserves the right to suspend or terminate the Service or your access to it at any time, with or without notice. This may occur due to regulatory requirements, security concerns, or other reasons. Tampay may take immediate action to protect the Service and its users in cases of suspected fraud or other serious issues. We will make reasonable efforts to provide notice of any suspension or termination, but we are not liable for any damages or losses resulting from such actions.
Limitation of Liability
To the fullest extent permitted by law, Tampay and its affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service. This includes damages resulting from errors or omissions in the Service, delays in performance, or issues related to third-party products or services. Tampay’s liability, if any, features offered in the Service.
Dispute Resolution
The laws of Nigeria govern these Terms. Any disputes arising from or related to these Terms will be resolved through mediation in Lagos, Nigeria. If mediation does not resolve the dispute, you may seek relief through the courts having jurisdiction over the Parties and the subject matter of the dispute. Tampay may seek injunctive relief to protect its rights and interests.
Modifications to Terms
Tampay may update these Terms and related policies at any time. When changes are made, we will communicate them to you through the Service or other means. If you continue to use the Service after changes are made, that means you have agreed to be bound by the revised Terms. It is your duty to ensure that you review these Terms periodically.
Entire Agreement
These Terms, along with the Privacy Policy and any other policies or agreements referenced, constitute the entire agreement between you and Tampay regarding the use of the Service. Any modifications or waivers must be documented and approved by Tampay to be effective.
Sever-ability
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue to be valid and enforceable. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it enforceable while maintaining the original intent of the provision.
